The terms and conditions that govern your use of the Oodlins school management system

These Terms of Service ("Terms") govern your use of the Oodlins school management system, including our website, school app and parent app (collectively, the "Services"). By using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Who May Use the Services

Oodlins is provided by Squincy Sdn Bhd for schools, teachers, parents and guardians. You may use the Services only if you can form a binding contract with us and only in compliance with these Terms and all applicable laws. Schools and administrators are responsible for ensuring that only authorised staff access the administrative functions. Parents and guardians must be authorised by the relevant school to access their child's information.

2. Account Registration and Responsibilities

  • • Accuracy of information – When creating an account, you agree to provide accurate and complete information and to keep it up to date.
  • • Security of your account – You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Do not share your password with anyone or allow others to use your account.
  • • Notifying us of unauthorised use – If you suspect any unauthorised use of your account, you must notify us immediately so we can take appropriate action.
  • • Parent and guardian responsibilities – Parents are responsible for monitoring their child's use of the Services and ensuring that their child understands and follows these Terms.
  • • Administrator responsibilities – Teachers and administrators may access students' data only for legitimate educational purposes. They must not disclose personal information to unauthorised parties or use it for any non-educational purpose.

3. Acceptable Use

You agree to use the Services only for lawful, educational purposes and in a way that does not infringe the rights of others. In particular, you must not:

  • • Post or upload any content that is illegal, harmful, defamatory, abusive, discriminatory or otherwise objectionable.
  • • Violate any applicable laws, regulations or school policies.
  • • Attempt to gain unauthorised access to other accounts, computer systems or networks connected to the Services.
  • • Interfere with or disrupt the integrity or performance of the Services.
  • • Transmit viruses, malware or any other harmful computer code.
  • • Collect or disclose personal information about others without proper consent.

We reserve the right to suspend or terminate accounts that engage in prohibited activities.

4. Intellectual Property Rights

Our content and software

The Services, including the underlying software, user interfaces, designs, graphics, logos and trademarks, are owned by Squincy Sdn Bhd or our licensors and are protected by copyright, trademark and other intellectual property laws. You may use the Services only for their intended educational purpose and may not copy, modify, distribute, sell or lease any part of our Services without our written permission.

Your content

If you upload or submit any content (such as assignments, messages or photos), you retain ownership of that content. By submitting content, you grant us a limited licence to host, store and process it as necessary to provide the Services. You represent that you have the necessary rights to upload the content and that it does not infringe any third-party rights.

Respecting third-party rights

Do not upload materials that infringe others' intellectual property rights. If you are a rights holder and believe that content on our Services infringes your rights, please contact us.

5. Disclaimer of Warranties

We strive to provide useful and reliable Services, but we do not warrant that the Services will be uninterrupted, error-free or completely secure. To the extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Services will meet your requirements or that any defects will be corrected. Your use of the Services is at your own risk.

6. Limitation of Liability

To the maximum extent permitted by applicable law:

  • • We will not be liable for any indirect, incidental, special or consequential damages, including loss of profits, loss of data or goodwill, arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.
  • • Our total liability for any claims arising from or related to the Services will not exceed the greater of (i) the amount you have paid to us (if any) in the twelve months preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars (or the equivalent in local currency).

Nothing in these Terms excludes or limits liability to the extent that it cannot be excluded or limited under applicable law.

7. Indemnification

You agree to defend, indemnify and hold harmless Squincy Sdn Bhd and our officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Services or violation of these Terms.

8. Termination of Accounts

We may suspend or terminate your account or access to the Services at any time, with or without notice, if you violate these Terms or engage in any conduct that we believe is harmful to the Service or other users. Schools may also request that we deactivate accounts when a student leaves the school or at the end of a subscription term. You may terminate your account at any time by contacting us. Upon termination, your right to use the Services will cease. We may retain certain information as required by law or as necessary for legitimate educational purposes.

9. Changes to the Terms

We may modify these Terms from time to time. If we make material changes, we will provide notice (for example by email or through the Services) and indicate the date of the last update. Your continued use of the Services after the changes come into effect constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of Malaysia, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Malaysia to resolve any dispute arising out of these Terms or the Services.
